Falls by hospital patients and nursing facility residents are daily occurrences that usually are the fault of healthcare providers. I successfully have pioneered patient/resident falls as a viable genre of medical malpractice for decades.

The two most common types of medical malpractice in hospitals are medication errors and patient falls. I handle both regularly, plus surgical and other errors.

Nursing Homes

The two most common types of medical malpractice in nursing facilities are pressure wounds and resident falls. Again, I handle both regularly.

INCIDENT
REPORTS

In 2006, I established the right of medical malpractice victims to obtain healthcare incident (accident) reports and staff educational/training materials and to use them as evidence at trial. My landmark opinion from the Virginia Supreme Court still stands today and, moreover, continues to be controlling legal authority for patients obtaining and using other types of records about them that healthcare providers inappropriately segregate, withhold, and claim are privileged from disclosure.

BRAIN
IMAGING

In 2010, I employed cutting-edge 3.0 Tesla MRI – most MRIs still are the less-revealing 1.5 Tesla – to neutralize defense expert claims that my brain injury client simply was exaggerating and malingering, obtaining a $6,000,000.00 jury verdict in Gloucester. In 2012, I reportedly was the first lawyer in any Virginia Circuit Court to introduce brilliant Diffusion Tensor Imaging (“DTI”) into evidence at trial to prove brain injury, obtaining a $3,500,000.00 jury verdict in Newport News.

ELECTRONIC
RECORDS

During 2014-2016, I pioneered Virginia patients obtaining by printout, by electronic copy and/or by on-site (expert) inspection all of the audit trails and metadata for their electronic medical records maintained by healthcare providers. The half-dozen favorable opinions and orders I obtained from Virginia Circuit Courts are published authority, used by other lawyers and even taught in continuing legal education seminars.

OTHER
INNOVATIONS

As zealous advocate, I think outside the box and push the envelope, creatively and progressively. For decades, for example, I have championed obtaining insurers’ accident reports, witness recordings/statements, and other claim files for my car accident clients; and obtaining healthcare providers’ policies/procedures, pilot programs, and investigative materials for my medical malpractice clients – resulting in dozens of published Court orders and opinions.
