On June 17, 2019, the Supreme Court of the United States in Virginia House of Delegates v. Bethune-Hill, No. 18-281, upheld the 2018 finding by the Richmond Division of the United States District Court for the Eastern District of Virginia that the Republican-controlled General Assembly of Virginia unconstitutionally had redrawn eleven (11) House Districts through racial gerrymandering. See, 326 F. Supp.3d 128, 180 (E.D.Va. 2018). Significantly, writing for the 5-4 majority, Justice Ginsburg  noted: “After the General Assembly failed to enact a new redistricting plan within the four months allowed by the District Court, that court entered a remedial order delineating the districts for the 2019 election.” No. 18-281 at n.1. Therefore, with new racially-neutral voting districts,  Virginia’s House this year stands to become Democratic for the first time in decades.
