By Order entered June 7, 2018, United States District Court for the Western District of Virginia in Harrisonburg granted Plaintiff’s motion for voluntary dismissal pursuant to Federal Rule of Civil Procedure 41(a); held that such dismissal is the “equivalent of a non-suit for purposes of applying Virginia Code §8.01-229(E)(3)” for 6 months tolling of the statute of limitations; and ruled that Plaintiff was entitled such dismissal “as a matter of unconditional right” since it was filed before Defendant filed any Answer or Motion for Summary Judgment, despite Defendant having filed a Motion to Dismiss. The wrongful death case is Sullins v. RSW Regional Jail Auth., No. 5:18-cv-0006.
